We are convinced that in conflict situations, an amicable solution can be worked out and found and that the solutions found in this way are therefore more sustainable and permanent. In addition, alternative conflict resolution offers those affected the opportunity to maintain their self-determination in the conflict.

Mediation

The focus of our offer is on mediation as a consensual, mutually agreed conflict resolution process. We refer to mediation as an independent process for comprehensive and mutually agreed conflict resolution. The process is generally suitable for conflicts in general, even without a direct legal connection. Mediation can also be used preventively to deal with complicated topics and issues in a guided setting and to prevent a conflict from occurring in the first place.

With the help of structural and communicative support from the mediator, those involved can find individual and sustainable solutions. Particularly, teams and companies can be supported when problems or changes occur. In the case of separation, divorce, or other conflicts in the family, such as inheritance disputes or sibling conflicts, such support from the mediator can make an appropriate solution possible.

As a rule, a mediation procedure requires 6 to 8 sessions lasting 2 hours each, at the end of which an agreement binding on all parties is to be reached.

It is also possible to design a mediation process, particularly in a business context, so that it suits the respective company. This means that work can also be carried out in block sessions or daily mediations.

Arbitration proceedings

We also offer the arbitration process to resolve the conflict. The arbitration process differs from mediation in that the arbitrator can and wants to bring the conflict to an end in the form of a binding agreement. This is done by proposing a concrete solution considering the mutual interests and positions. This usually requires 3 to 4 appointments of 2 hours each.

The arbitration procedure is not only aimed at private individuals and companies, but also at public bodies, institutions, and foundations.

Legal advice and cooperative practice

We also provide legal advice, but we do not focus on contentious proceedings, but always in a mediative and solution-oriented manner out of court. We are not limited to a specific area of law but concentrate on civil law.

In cooperative practice, we offer out-of-court conflict resolution with appropriately trained colleagues. Cooperative practice is a voluntary out-of-court conflict resolution procedure in which the parties, their lawyers and, if necessary, other experts work together towards an out-of-court settlement.

It is a good way to find an amicable solution when the parties are represented by a lawyer, but both sides want to avoid legal proceedings.

The added value for clients and those involved in the conflict lies particularly in the goal of our work.

Our legal and mediation advice aims to resolve conflicts and issues for those affected in such a way that the result is better than what is possible as an alternative through a costly or lengthy legal procedure.

Cost savings: The amicable resolution of conflicts saves considerable costs, as neither court costs nor the high legal fees of a court case are incurred.

Time savings: A possible court case can drag on for months or years, while an amicable conflict resolution can usually be achieved much more quickly.

Stress: The psychological stress and uncertainty of a court case are eliminated.

Relationship aspect: Those involved must be willing to resolve the conflict amicably, which will place less strain on the relationship between the parties.

Flexibility: Those involved can find their individual solutions that better meet their needs than a decision made by a court ruling.

This type of legal and mediation work is relevant in both private and business environments:

In relation to private customers, conflicts are perceived differences between people that significantly impair or hinder the goals and interests (needs) of at least one of the parties involved. The responsibility for the hindrance is seen with the other party. The process is usually accompanied by strong emotions. It is precisely this dynamic that we want to take up with our alternative approach and bring it into a legal framework to enable a sustainable solution.

In this respect, our separation and divorce mediation service offers another special feature. Our concept is to give the children who may be affected by a separation a voice in conflict resolution. We provide appropriate interviews for the children with appropriate psychological specialists. At this point, reference should be made to the collaboration with the colleagues named in the Team.

 

Regarding companies, it is clear that they have an increased interest in good and fair conflict management within the company in order to resolve possible conflicts economically and sensibly while taking the interests of the employees into account.

We want to offer a sustainable solution through our approach in the event of a company handover, succession, change or termination. Conflicts can be expensive, there is a risk of losing good staff and the quality of work suffers when the focus is on the dispute, so it is worth ensuring harmony.

About Us

Michel Boven

The partner and founder of the law firm is Michel Boven, certified mediator, lawyer and arbitrator.

In addition to studying law, he has always been interested in the field of interpersonal relationships as a component of a conflict. He then pursued this interest in training as a certified mediator at the Heidelberg Institute and the University of Heidelberg, as well as training as an arbitrator at the Urach Academy.

Further he joined the law firm die Konfliktoren GbR/Schlichtungsstelle in Bad Urach until February 2024 and has worked as a mediator, arbitrator and lawyer since then.

The focus of the work is on consensual, amicable conflict resolution, taking into account legal and psycho-emotional concerns.
